Democratic Attorneys General Gear Up To Defend Biden Policies Ahead Of Trump’S Second Term

As Donald Trump prepares to take office for his second term on Monday, Democratic states are taking proactive steps to defend key policies of the Biden administration. Attorneys general from more than a dozen Democratic-led states, including California, New Jersey, and Michigan, have launched a legal campaign to protect Biden’s policies on immigration, environmental regulations, and gun control.

This action comes as Trump has promised to dismantle many of Biden’s policies, including efforts to offer health insurance to immigrants brought to the U.S. illegally as children, enforce environmental protections, and uphold transgender rights. With the Republican Party controlling Congress and Trump poised to wield significant influence in the White House, these state attorneys general are stepping in to ensure that Biden’s policies are defended in the courts.

On Wednesday, the attorneys general filed a motion with a federal judge seeking to defend a Biden administration rule that provides health insurance to immigrants brought to the country illegally as children—a measure recently challenged by a group of Republican attorneys general. This rule had previously been defended by the Department of Justice, but the Democratic AGs raised concerns that the incoming administration’s Justice Department might not vigorously defend the case.

“These are crucial rules that protect our residents, and there’s a strong chance that the Trump administration will not defend them,” said New Jersey Attorney General Matt Platkin. Similar coalitions of Democratic AGs are working to intervene in other cases, including those related to environmental protection, gun dealer regulations, and devices known as “forced reset triggers,” which allow firearms to fire more rapidly.

While Trump is entitled to pursue his agenda, Platkin stressed, “He is not entitled to violate the rule of law or undermine our residents’ rights in ways that harm them.” The attorneys general hope to use their collective legal power to block actions that they believe would negatively impact the well-being of their constituents.

Over the past decade, coalitions of state attorneys general have used the courts to challenge federal policies across various sectors, from healthcare to energy to financial regulations. During Trump’s first administration, Democratic AGs filed 155 lawsuits, with an 83% success rate. Given the anticipated legal challenges Trump will bring to the Biden administration, political experts expect a surge of lawsuits from Democratic AGs early in his second term.

While the legal landscape has shifted with Trump’s judicial appointments, including conservative changes to the Supreme Court, Democratic AGs now benefit from a more seasoned and experienced legal team, having learned from the challenges they faced during Trump’s first term.
