Trump Administration Moves To Expel Migrants Admitted Under Biden Programs

The Trump administration has taken steps to quickly remove migrants who were temporarily admitted to the US under two programs introduced during the Biden administration. A memo signed by Acting Homeland Security Secretary Benjamin Huffman allows immigration  authorities to begin deporting these migrants, who were admitted under programs that critics claimed were illegal.

Over 1 million migrants entered the US under these programs, which were part of the Biden administration’s efforts to create “lawful pathways” for asylum seekers. These pathways were designed to discourage illegal border crossings by providing legal ways for migrants to enter the US. However, immigration hardliners argued that the programs themselves were unlawful.

One of the programs allowed migrants to schedule appointments at ports of entry through the CBP One app to begin their asylum claims. The Trump administration shut down this app’s scheduling function on Monday, leaving many migrants waiting at ports of entry in Mexico in despair. Another program, which admitted people fleeing Cuba, Haiti, Nicaragua, and Venezuela, was also terminated this week.

The memo, first reported by The New York Times, directs ICE agents to review each case individually to determine the appropriate enforcement action. It also expands the use of expedited removal, a process originally used for recent border crossers, to migrants who have been in the US for up to two years. This allows immigration authorities to bypass parts of regular immigration law and speed up deportations.

Immigrant advocates are concerned that people who fled dangerous situations may be forced to return quickly. “For this administration, cruelty and chaos are the point,” said Kate Jastram, director of policy and advocacy at the Center for Gender & Refugee Studies.

The memo instructs authorities to prioritize migrants who have been in the US for a year but have not applied for asylum. For those who do not qualify for expedited removal, authorities are directed to consider placing them in regular deportation proceedings.
