Amazon Settles $4M Lawsuit Over Alleged Tip Theft

Amazon has agreed to pay $3.95 million to settle a lawsuit filed by the District of Columbia, in which the company was accused of unlawfully using customers’ tips to offset its own labor costs. The lawsuit, filed by D.C. Attorney General Brian L. Schwalb, alleged that Amazon misled consumers between 2016 and 2019 by claiming that all tips given to Amazon Flex drivers—employees who use their own vehicles to deliver packages—would be passed on in full to the workers.

Schwalb stated that Amazon’s actions diverted millions of dollars in tips, which were intended to supplement drivers’ base wages, allowing the company to lower its operating costs and boost profits. “When companies mislead customers to boost their profits by stealing tips intended for their workers, they are cheating their consumers, their employees, and their competitors who play by the rules,” Schwalb remarked.

Violation of Consumer Protection Laws

The legal dispute centers around the claims that Amazon’s payment model, implemented through its Amazon Flex program, was deceptive. Initially, customers were told that 100% of their tips would go to the delivery drivers. However, the lawsuit revealed that, in 2016, Amazon adjusted its payment structure so that the tips were used to cover base wages for drivers, a fact not disclosed to either the consumers or the drivers themselves. The Federal Trade Commission (FTC) confirmed that this change was never communicated to customers, allowing the practice to continue until 2019, when Amazon became aware of an ongoing FTC investigation.

Despite Amazon’s contention that the Flex program has since evolved, the company agreed to the settlement in order to resolve the matter. In a statement, Amazon spokesperson Steve Kelly said, “While we continue to disagree with these allegations, we’re happy to have the matter behind us so we can continue to focus on supporting delivery partners and customers.”

Fines and Restitution: Legal Repercussions for Amazon

Under the settlement terms, Amazon will pay a $3.95 million sum, which includes $2.45 million in penalties and $1.5 million in legal costs. Although Amazon has denied the allegations, the D.C. Attorney General emphasized that the financial penalties were necessary to deter future unlawful conduct. Schwalb stated, “It’s not sufficient, after being caught, to simply give back the ill-gotten gains. There must be meaningful consequences to deter misconduct from happening in the first place.”

The settlement follows a 2021 FTC resolution, which mandated that all tips in question be returned to drivers. However, the D.C. lawsuit is separate and specifically seeks injunctive relief and civil penalties as a deterrent against future deceptive practices.
